Please read these Terms and Conditions (“Terms”) carefully before purchasing, downloading, or using any product, software, course, or service offered by ActionSeps™ (“we,” “us,” “our”). By completing a purchase or accessing any product, you agree to be bound by these Terms in full.

1. Acceptance of Terms

By accessing or using this website (actionseps.com), purchasing any product, or downloading any file, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use this site or purchase our products.

2. Products & Services

ActionSeps™ offers the following categories of products and services:

• Software & Tools – Including the ActionSeps™ separation tool suite, DTX Live system, Photoshop plugins, and related software products.
• Digital Downloads – Including templates, art approval forms, registration templates, koozie templates, and other downloadable files.
• Online Courses & Educational Content – Video-based courses, tutorials, and digital training materials.
• Separation Services – Custom screen printing separations performed by ActionSeps™ for clients.

3. Refund Policy

3a. Software & Online Courses

We offer a 100% satisfaction guarantee. If you have completed all course lessons or fully implemented the software and it does not work as described, you may request a full refund by visiting actionseps.com/help.

Refund requests must be submitted within 30 days of purchase. We reserve the right to verify implementation before issuing a refund.

We do not offer refunds for:

• Partial completion of courses or tools
• Change-of-mind after download or access is granted
• Purchases where the product was used to develop competing tools, systems, or derivative works (see Section 7)

3b. Digital Downloads (Templates & Files)

All sales of digital downloads are final and non-refundable. Once a file has been downloaded or access has been granted, no refund will be issued. This applies to registration templates, art approval templates, koozie templates, and all other downloadable assets.

If you experience a technical issue preventing download or access, visit actionseps.com/help within 7 days and we will resolve it promptly.

3c. Separation Services

• Standard production time: 48–72 business hours
• Peak season (April – mid November): up to 72 business hours
• Business hours: Monday–Friday, 9AM–5PM CST
• Rush/same-day 24-hour service is available at an additional fee

No refunds are issued for completed separation orders. If there is a quality issue with your completed order, we will remake it at no charge. All concerns must be reported within 5 business days of delivery.

4. Pricing, Payment & Subscriptions

All prices are listed in USD. We reserve the right to change pricing at any time without notice, except for active subscriptions which will receive 30 days’ advance notice of any price change.

For subscription-based products:

• Subscriptions renew automatically at the stated interval until cancelled.
• You may cancel at any time through your account dashboard or by contacting support.
• No refunds are issued for partial subscription periods.

5. Intellectual Property Rights

5a. Ownership

All content on this website — including but not limited to software, source code, Photoshop actions, separation techniques, course videos, written materials, brand names, logos, color schemes, UI/UX design, product names, marketing copy, and methodologies — is the exclusive intellectual property of ActionSeps™ and its owner, Matthew Chevalier, protected under:

• United States Copyright Law (17 U.S.C. § 101 et seq.)
• Trademark and Trade Dress Law (Lanham Act, 15 U.S.C. § 1125)
• Applicable state and international intellectual property laws

5b. License Grant

Purchase of any ActionSeps™ product grants you a limited, non-exclusive, non-transferable, revocable license to use the product for your own personal or commercial screen printing or decoration work. This license does not grant you any rights to:

• Reproduce, resell, sublicense, or redistribute any product or its components
• Reverse engineer, decompile, or extract source code or underlying techniques from any software or plugin
• Use any ActionSeps™ product as the basis for a competing tool, software application, plugin, system, course, or service
• Copy, replicate, or substantially imitate the functionality, design, branding, user interface, workflow, methodology, or marketing of any ActionSeps™ product

Any violation of this license immediately terminates your rights to use the product and may result in legal action.

5c. Prohibited Competitive Use

You expressly agree that you will not:

• Use any ActionSeps™ product, tool, software, or educational content as a reference, template, or starting point for developing a competing product or service
• Copy or substantially reproduce any ActionSeps™ brand elements, UI design, color schemes, product naming conventions, course structure, or marketing copy
• Create a product or service that is confusingly similar to any ActionSeps™ product in appearance, function, or name

Violation of this section constitutes both copyright infringement and trade dress infringement under federal law and will be pursued to the fullest extent permitted by law, including claims for actual damages, statutory damages, lost profits, and attorneys’ fees.

5d. Evidence & Enforcement

ActionSeps™ actively monitors for unauthorized copying and infringement. We maintain detailed records of all product releases, source code, design files, marketing materials, and customer access logs. These records constitute contemporaneous evidence of originality and may be used in any legal or administrative proceeding.

5e. DMCA

If you believe any content on this site infringes your copyright, please submit a notice at actionseps.com/help with the subject “DMCA Notice” and include the required information under 17 U.S.C. § 512(c)(3).

6. User Conduct

You agree not to:

• Use this site or any product for any unlawful purpose
• Attempt to gain unauthorized access to any part of this site or its systems
• Transmit harmful, harassing, or fraudulent content through any communication channel we provide
• Misrepresent your identity or affiliation in any support or communication interaction

7. Disclaimer of Warranties

Products and services are provided “as is” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Results from our courses and tools vary by user, equipment, and implementation. We do not guarantee any specific outcome, revenue, or production result.

8. Limitation of Liability

To the fullest extent permitted by law, ActionSeps™ and Matthew Chevalier shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of any product, service, or this website, even if we have been advised of the possibility of such damages.

Our total liability in any matter arising out of these Terms shall not exceed the amount you paid for the product or service in question.

9. Indemnification

You agree to indemnify, defend, and hold harmless ActionSeps™, Matthew Chevalier, and any affiliated parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of:

• Your use of any product or service
• Your violation of these Terms
• Your infringement of any intellectual property or other rights of any person or entity

10. Privacy

We collect and use personal information in accordance with our Privacy Policy, available at actionseps.com/privacy. We do not sell your personal data to third parties.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction in those courts.

Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute informally by visiting actionseps.com/help and allowing 30 days for good-faith resolution.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of this site or our products after any changes constitutes acceptance of the updated Terms.
